OSCR Publishes New Code of Fundraising Practice

The Fundraising Regulator has published a new Code of Fundraising Practice, set to come into effect on 1 November 2025. This revised code is designed to ensure that fundraising across the UK, including Scotland, remains safe, effective, and trusted by the public.

Fundraising is a cornerstone of many charities’ operations – not only as a source of income but also as a means of raising awareness. In the UK, charitable fundraising operates under a self-regulatory model, meaning that the sector itself sets the standards that govern fundraising practices, with a legal framework underpinning this approach. Trustees are ultimately responsible for ensuring that their charity – and anyone fundraising on its behalf – complies with the law and follows best practice.

The updated code, which has been developed through extensive consultation and engagement, introduces a principles-based approach to regulation. This shift moves away from prescriptive rules and instead empowers fundraisers to exercise sound judgement across a range of activities – including emerging and innovative fundraising methods.

The Fundraising Regulator reports that more than 6,000 comments were received during its comprehensive consultation process, which began in 2022. Stakeholders included over 200 fundraising organisations, members of the public, and other regulatory bodies. The result is a code that is 45% shorter, easier to navigate, and more accessible – especially for smaller charities or those new to fundraising.

Key updates include:

  • Stronger protections for fundraisers, including a requirement for organisations to take reasonable steps to prevent harm and harassment.

  • Improved guidance and signposting to legal obligations and best practice.

  • Support for innovation, ensuring the code can be applied flexibly to new fundraising technologies and approaches.

To help organisations prepare for the changes, the Fundraising Regulator is also releasing practical support guides on due diligence, documenting fundraising decisions, and monitoring fundraising partnerships. Additional guidance will be published in the lead-up to the code’s implementation.

Organisations will have a six-month transition period to update internal policies, train staff and volunteers, and seek advice as needed. The Fundraising Regulator will continue to support the sector through webinars, events, and its Code Advice Service in the months ahead.

This revised code aims to uphold public trust, promote accountability, and ensure that the UK’s charitable fundraising remains fit for the future.
